Terms of Service
The rules for using samplesh. Read them — using the site means you accept them.

1. Acceptance
By accessing or using samplesh (https://samplesh.com), you agree to these Terms of Service, the Privacy Policy, and the Cookie Policy. If you do not agree, do not use the site.
2. What samplesh is
samplesh is a personal music-discovery web application operated by Mehmet Baran Korkusuz in Türkiye. It pulls random videos from YouTube, enriches them with metadata sourced from third-party catalogues (Discogs, MusicBrainz, AcousticBrainz), and lets you filter the discovery pool by genre, country, decade, and view count.
It is a hobby project provided free of charge. There is no subscription, no paid tier, no user account system, and no commercial offering associated with the service.
3. Eligibility
You may use samplesh if you are at least thirteen years old, or the minimum digital- consent age in your jurisdiction (sixteen in some EU member states). If you are under eighteen, you should have permission from a parent or legal guardian.
4. Your licence to use the service
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use samplesh for personal, non-commercial purposes. The licence does not include any right to copy, modify, distribute, sell, sublicense, or create derivative works from the service or its underlying code or design beyond what is permitted by applicable law or by an explicit open-source licence.
5. Acceptable use
You agree not to:
- Scrape, crawl, mine, or otherwise extract data from samplesh or its API endpoints in bulk, or use bots, headless browsers, or automation to interact with the service in a way that exceeds normal human use.
- Bypass, disable, or interfere with rate limits, abuse-prevention controls, or any other security or technical measure.
- Stream-rip, re-record, or otherwise capture the audio or video stream that the embedded YouTube player delivers, or redistribute it.
- Use the service to violate intellectual-property rights, including by uploading, embedding, or sharing material you do not have the right to use, or by using the service to infringe a third-party copyright, trademark, or other right.
- Submit feedback that is unlawful, threatening, defamatory, harassing, hateful, or fraudulent, or that contains malware, phishing content, or chain-mail.
- Probe, scan, or test the vulnerability of the service without prior written permission.
- Reverse-engineer, decompile, or disassemble the service except to the extent applicable law permits despite this restriction.
- Use the service in a way that violates any applicable law or regulation.
We may apply rate limits, throttling, blocking, or other technical mitigations to protect the service. We may change these limits at any time without notice.
6. YouTube content
Videos surfaced through the service are streamed from YouTube via its embedded iframe player. sampleshdoes not host, store, or own the videos, the audio, or the artwork carried by them. All rights remain with the original creators and copyright holders. Availability, region restrictions, age gates, and takedown decisions are entirely under YouTube's control.
If you are a rightsholder and want a video excluded from the discovery pool, contact curcubaran@gmail.com with the YouTube video ID. We can add specific IDs to a server-side blocklist where feasible — but the canonical takedown route remains YouTube's own copyright process.
7. Third-party services and data sources
sampleshintegrates with third-party services. Your use of these features is also governed by the providers' own terms:
- YouTube IFrame Player API & YouTube Data API — subject to the YouTube Terms of Service and the Google Privacy Policy. By using samplesh you also agree to be bound by the YouTube Terms of Service.
- Google Analytics — subject to the Google Terms.
- Discogs — release metadata is sourced via the Discogs API; usage is subject to Discogs' policies.
- MusicBrainz / AcousticBrainz — used for BPM lookup; data published under Creative Commons CC0.
- Resend — feedback delivery, subject to the Resend Terms.
- ipapi.co — IP-based geo-lookup for feedback triage, subject to ipapi's terms.
- Amazon Web Services— hosting; subject to AWS's service terms.
We are not responsible for the content, availability, accuracy, or practices of any third-party service.
8. Open-source software
samplesh is built with open-source software, including (without limitation) Next.js, React, Tailwind CSS, Zustand, and Zod. Their use remains governed by their respective licences.
9. Disclaimers
The service is provided "as is" and "as available", without warranty of any kind, express or implied — including, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability. We do not warrant that the metadata, BPM, country, year, or any other field returned by the discovery engine is accurate, complete, or up to date.
10. Limitation of liability
To the maximum extent permitted by applicable law, the operator of samplesh shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or substitute service costs — arising out of or related to your use of, or inability to use, the service. Where liability cannot be excluded, total cumulative liability for all claims arising out of or relating to the service shall not exceed the greater of (a) the amount you have paid us in the twelve months preceding the claim (which is zero, as the service is free) or (b) EUR 50.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded — such as liability for death or personal injury caused by negligence, or for fraud.
11. Indemnification
You agree to indemnify and hold harmless the operator from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the service, or your violation of any law or third-party right.
12. Suspension and termination
We may suspend, restrict, or block access to the service — for an individual user, for an IP range, or globally — at any time and without notice, particularly where we reasonably believe these Terms have been breached or where the service's integrity or security is at risk. We may also discontinue, modify, or replace any part of the service at any time.
13. Changes to the service
samplesh is in active development. Features may appear, change, or disappear without notice. We do not commit to any specific feature or level of service.
14. Changes to these Terms
We may revise these Terms from time to time. The "Last updated" date at the top of this page reflects the latest revision. Material changes will be communicated by updating the page. Continued use of the service after a revision is published constitutes acceptance of the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law principles. Any dispute arising out of or in connection with these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts and execution offices of Ankara, Türkiye, except where mandatory consumer-protection laws of your country of residence grant you the right to bring proceedings in your local courts.
16. Force majeure
We are not liable for any failure or delay in performing our obligations under these Terms caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, governmental action, labour disputes, internet or hosting-provider outages, or third-party service failures.
17. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
18. No waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
19. Entire agreement
These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and the operator regarding the service and supersede any prior agreements.
